The Basics

What is a talent agency bond?

A talent agency bond is a surety bond required of agencies that procure employment for performers and other artists. Because agencies collect money on behalf of their clients and take commissions from it, the activity is regulated, and the bond is the financial guarantee that sits behind the license or franchise.

It guarantees that the agency will handle client funds properly and comply with the statutes governing talent representation: paying artists their earnings promptly, taking only commissions the law or the franchise agreement permits, keeping trust accounts and records straight, and not charging prohibited advance or registration fees. If an agency fails to remit what a performer is owed, that performer can claim against the bond, the surety pays what is valid, and then recovers from the agency.

There are two overlapping requirements to be aware of. State licensing comes first: California, New York, and a number of other states license talent agencies through a labor commissioner or department of licensing, each with its own bond form and amount. Separately, the performers unions franchise agencies that represent their members, and franchise agreements carry their own bonding conditions. Many agencies end up satisfying both.
