What is an employment agency bond?
An employment agency bond is a license and permit surety bond that states, and in some places cities, require before an employment or placement agency can be licensed. It guarantees that the agency will operate according to the statutes governing job placement: charging only lawful fees, refunding fees when required, keeping accurate records, and dealing honestly with both job seekers and employers.
The protection runs to the applicants who pay you and to the employers who rely on you. If a job seeker is charged an unlawful fee or is owed a refund that never arrives, they can file a claim against the bond. The surety investigates, pays what is valid, and then recovers from the agency, since a bond guarantees your conduct rather than insuring your losses.
Terminology varies by state, and so does scope. Depending where you operate the same license may be called an employment agency, employer service, staffing agency, or theatrical or domestic placement agency license, and some states regulate nurse registries and farm labor contractors under closely related statutes with their own bond forms.
