What is a nail salon wage bond?
A nail salon wage bond is a surety bond that New York requires from appearance enhancement businesses as part of the bonding and insurance rules the Department of State adopted to protect salon workers. Salon owners have to have the bond in place to obtain and keep their license.
The bond exists because of a specific problem: workers in this industry were going unpaid, underpaid, or paid below minimum wage, with little practical recourse. The bond gives them one. If a salon fails to pay wages the law requires, an employee or the state acting on their behalf can make a claim against it. The surety pays valid claims and then recovers from the salon owner, so it functions as a guarantee of your payroll conduct rather than as insurance covering it.
The requirement sits alongside the other obligations of an appearance enhancement license: proper licensing of the individuals performing services, workers compensation and disability coverage where required, ventilation and safety standards, and posting the worker bill of rights. The bond is generally the piece that most often holds up a licensing file, simply because owners do not know where to get one.
